The following terms will have the specific meanings assigned to them in these “Terms and Conditions.”

Rewards

 

Week
Weekly Prize:

Means the reward program named” Izihirwe with MTN YOLO” organized by MTN to reward its MTN YOLO customers between the period of 31st May 2019 and 30th August 2019 all MTN YOLO customers.
Monday to Friday
Means prizes to be awarded weekly to winners for a period of 12 weeks. This will be awarded to a total of 24,598 participants per week over the specified period.

Commencement:

Means 12 am on the 31st May 2019

Ending/Conclusion/Completion:

Means 11.59pm 30th  August 2019

Time:

Means Rwandan local time, as observed in Kigali, Rwanda.  To clarify, all time references in these Terms and Conditions are referring to GMT+2.

Terms and Conditions:

Means these Terms and Conditions, including all the annexures and amendments thereof.

Confirmed Prize Winner:

Means a Participant who as a Winner of a Prize under these Terms and Conditions has been confirmed by the Organizer to be entitled to receive and has accepted to receive the corresponding Prize.

Subscriber/customer:

Means, a person who is active on the MTN Network and/or has during the period of Izihirwe with MTN YOLO.

   

Participant:

Means a person who has joined Izihirwe with MTN YOLO by dialing *154*6# to participate in the draws for the weekly prizes. Provided all are permitted by these Terms and Conditions to participate in the Rewards.

   

Prizes:

Means the Weekly Prizes in Three (3) categories

Winner:

Means a Winner in any of the categories of Prizes set out above.

MSISDN:

Mobile Station International Subscriber Directory Number.

MTN RwandaCell with its principal office at MTN Centre Building, Nyarutarama, Kigali, Rwanda, (hereinafter referred to as “MTN/Organizer”) and owns the Network for the launch of “Izihirwe with MTN YOLO” (hereinafter referred to as the “Rewards”).

The present Terms and Conditions shall apply to all intending Participants in the Rewards. During the period of the Rewards, the Terms and Conditions shall be available at no cost whatsoever to all the Participants at http://www.mtn.co.rw (“Rewards Website”) and may be subject to amendments at MTN’s sole discretion, as stated in these Terms and Conditions.

The Participants will be able to obtain additional information regarding the Rewards and the Terms and Conditions by calling 100 from a mobile telephone that is subscribed to MTN’s mobile network. The calls to these lines shall be Toll free and the lines will be open 24 hours a day.

  • Izihirwe with Yolo Promotion Duration

The Izihirwe with MTN YOLO will run for 92 days from 31st of May 2019 to 30th of August 2019 inclusive (hereafter “Term”).

2. Territory

The prizes will be valid in the territory known and recognised as The Republic of Rwanda (hereafter called “Rwanda”).

3. Izihirwe with YOLO Promo Target

The prizes are open to all individual customers that are eligible for MTN YOLO services that are resident in Rwanda (the “Customers”).
The Participant hereby warrants and represents that he/she:

  • Is at least 16 years old and eligible to participate in Izihirwe with MTN YOLO in the same manner as being eligible to own a SIM card under Rwandan law,

Is joining voluntarily and free

  • Has perused and has a clear understanding of the terms and conditions of the Izihirwe with Yolo Promotion, and agrees that his/her participation in the Izihirwe with Yolo Promotion is conditional on full adherence to the terms and conditions herein,
  • The customer, is fully aware and accepts that using their MTN Sim cards on Voice calls and Voice subscriptions, Internet usage and Internet subscriptions, SMS usage purchased and used on the MTN platform after joining the Izihirwe with Yolo Promotion shall only count for the purpose of this Promotion.
  • Is fully aware and accept that joining Izihirwe with MTN YOLO is free.
  • Agrees that where there is any dispute as to the usage value by the Participant, the details records shall be the sole basis for resolving same.

MTN Rwanda reserves the right to verify the eligibility of Participants which will also include confirmation of details of Participants against the Participant’s details in MTN’s Subscriber SIM Registration records. Participants hereby agree that personal data supplied when participating in the Rewards may be used by the Organiser to monitor participation in the Rewards, to provide services to Participants from time to time and to evaluate service improvements.

4. Means of Participation

      • All MTN YOLO customers shall participate for free of charge
      • MTN sales partners such agents, dealers are not allowed to participate
      • MTN Staff and their spouses are not allowed to participate

4.2        Entry in the Izihirwe with MTN YOLO provided in clauses 4.1.1 shall qualify as one (1) entry in the prizes draws

4.3    To be a winner, Participants must have done revenue generating activities on MTN YOLO Platform only. Upon selection, the Participant must present a valid ID and his/her active MTN line with him/her at the point of prize collection.  Prize collection details shall be communicated by MTN Rwanda.

4.4 Winner Selection

For the avoidance of doubt, winner selection will be held every Friday of the week, in respect of the PRIZE PERIODS in the preceding week. Prize selection will be held at MTN discretion at its offices.

5. Prizes
For the purposes of this Izihirwe with MTN YOLO, MTN Rwanda will award the weekly prizes (hereafter “Prizes”) highlighted in Table 4.4 above
The Participant accepts that the prizes shall be received ‘as is’ and Organizer does not give any guaranty or warranty on the specifications, use, utility or fitness for purpose, of the prizes and shall not be liable for any manufacturer’s obligations, directly or indirectly.

From the moment a prize is handed over to winner, the winner shall be responsible for all other associated costs including transport and other costs.
Any withholding, income, or other taxes, charges or expenses associated with any Prizes and their collection shall be the Winner’s responsibility.

Each Participant (and/or MSISDN) is eligible to win only one Prize in Category I throughout the duration of the Izihirwe with MTN YOLO in respect of the weekly prizes. However, this doesn’t exclude winner in Category I to win in other categories.

Winners of prizes in Category I shall be contacted via voice calls from MTN’s line +250784000000, with details on how to redeem their prizes. NO WINNER in Category I SHALL BE CONTACTED VIA TEXT MESSAGE EXCEPT FOR REMINDING THEM TO COME AND COLLECT THEIR PRIZES.

Winners of prizes in Category II and Category III shall be contacted via TEXT MESSAGE with a sender ID ‘MTN’ with details on how to redeem their prizes.
MTN Rwanda SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY LOSS OR DAMAGE FROM ANY RELIANCE, COMMITMENT, EXPENSES INCURRED OR SUFFERED BY PARTICIPANTS IN FURTHERANCE OR RESPONSE TO ANY UNAUTHORISED OR FRAUDULENT TEXT MESSAGES, CALLS, WEBSITES OR DEMANDS FROM UNAUTHORISED PERSONS.

During a period of thirty (30) days following the end of each Selection, at least three attempts will be made to communicate by telephone from MTN’s designated line with the selected winner using the MSISDN corresponding to the entry, in order to notify the winner of the prize awarded and how it may be claimed. Some personal data will be required of the winner, including but not limited to: name, government issued identification document and SIM card, to verify his/her identity. 

In the event that it is not possible to establish a telephone communication with the winner and when the aforementioned attempts for such purpose have been made, the Winner will be replaced with someone else. MTN Rwanda is only under the obligation to make reasonable efforts to establish telephone communication with the Winner and is not in a position to guarantee successful connection. The rights of the Winner at this point automatically extinguishes if MTN Rwanda is unable to reach him/her after thirty (30) days, MTN Rwanda shall not be held liable for the inability to reach any Winner or failure to present the prize to the Winner.
Any expense not explicitly indicated as part of the prize, including but not limited to insurance, travel expenses, accommodation, license fees or taxes, are the responsibility of the winner.

Winners are considered to be the registered holders of the winning MSISDNs. For the purpose of claiming the Prize, Winners shall have to present themselves physically along with the National Identification corresponding to the MSISDN registered by the participant in the Izihirwe with Yolo Promotion and respective identification; otherwise they will have no right to the Prize which they were considered for. In the event that the Winner is unable to satisfactorily prove the ownership of the MSISDN as required, such Winner will be disqualified from being awarded the Prize and the Prize will be awarded to the following Substitute.
The names of the winners and the prizes awarded will be published on the MTN Rwanda Website http://www.mtn.co.rw as well as the official MTN social media platforms.

Winners are required to accept the prize. If the winner does not accept the prize, MTN Rwanda reserves the right to give the prize to other customers.
Prizes will be claimed by the respective Confirmed Prize Winners in person. In the event that the Participant declines the prize, he/she will have to express such intention in writing to MTN Rwanda, whereby the prize shall be awarded to the following Substitute.

Prizes not redeemed within thirty (30) days shall be deemed forfeited without any liability to MTN Rwanda.

6. Disqualifications
Any Participant may be disqualified at any stage of the Rewards, for any of the following reasons:

  • In the event that the winner does not sign the declaration of acceptance of the Prize, irrespective of the reason(s) for such;
  • In the event that the winner does not provide an acceptable identification document as registered on his/her SIM card as required by these Terms and Conditions;
  • In the event that the winner, for whatever reason(s), does not accept in full and without reservation the Terms and Conditions and his/her obligations which arise from the acceptance of such regulation, in respect of the allocation of the prize;
  • In the event of incompatibility arising from the selected winner lacking legal capacity (e.g. the fact that the selected winner is related directly or indirectly with the Organiser or is under-aged) in accordance with that set forth in the present Terms and Conditions.
  • The failure to comply with or observe any of the terms of Rewards set out herein.
  • In the event that the Winner is seen or found to have participated in the Rewards by way of fraud, deceit or in any manner which contravenes the spirit and intent of the Rewards, the terms and conditions herewith or in a manner prejudicial and/or unfair to other Participants.
  • Employees of the Organiser, MTN Dealers, and any company directly collaborating with the Organiser for the purposes of executing the Rewards, their spouses, direct members of their families or households, relatives of direct kinship or any other person in a position to benefit illegitimately from unpublished or privileged information connected to the Rewards, and all persons in a position to interfere with the operation of the Rewards (legitimately or illegitimately) are disqualified from participating in this Rewards.
  • In the event that the same MSISDN has previously won a Prize in the Category I.
  • For any other reason which MTN may, at its discretion deem fit.

7. General Conditions

  • The Rewards and features within the Rewards may also be protected by intellectual property rights belonging to the Organiser or to their licensors. No licence is granted to Participants in respect of any such rights, except to the extent required for Participants personal use of the Rewards in accordance with these terms and conditions. “MTN" and any other MTN product or Rewards name are trademarks of MTN and Participants shall not be entitled to reproduce such marks (other than to the extent required for Participants personal use of the Rewards) without MTN’s prior written consent.
  • Some aspects of the Rewards may be supplied to the Organiser by third parties and while the Organiser shall exercise all due care to ensure that such third parties comply with all applicable rules, the Organiser makes no promises, and does not accept any liability, either express or implied as to the Rewards, including but not limited to its accuracy, relevance or quality, except as stated in these Terms and Conditions.
  • Any participation in the Rewards is entirely at the risk of the Participant and in no event shall the Organiser be liable for any direct, indirect, incidental or consequential damages including without limitation loss of income, data or other information as a result of the use of or inability to use the Rewards.
  • Any deviation from the rules and/or attempt to manipulate the outcome of the Rewards or the entitlement to a Prize will result in an automatic disqualification of that Participant. The Organiser shall be entitled to affect the disqualification without reference or recourse to the Participant(s) carrying out the said manipulation.
  • The Organiser reserve the right to modify, supplement or terminate all or part of this Rewards at any time without notice and without liability of any kind, except with regard to winnings that have legitimately accrued and that the Organiser have recognised before the date of such modification, supplement or termination.
  • The Organiser reserves the right to * the advertised prizes with prizes of the same or greater value at their sole discretion.
  • Prizes are non-transferable in whole or in part and must be taken as stated.
  • Winners agree to the publication of their names and /or photographs in any media.
  • The Organiser accepts no responsibility for any incorrect or incomplete registration details that Participants may supply as part of the registration of their SIMs or for the Rewards.
  • The Organiser gives no warranty or guarantee whatsoever in relation to any Prize and Participants hereby release and hold the Organiser and their agents harmless from any and all liability, injury, loss or damage of any kind, so far as it is permitted by law, arising from the participation or Participant’s acceptance of use or use of any Prize.
  • The Organiser reserves the right to disqualify any entry at its sole discretion.

8. Organiser Responsibilities

The Organiser’ liability only encompasses giving out the Prizes to the Confirmed Winners and does not include any obligation on account of physical and/or legal defects arising from the Prizes.  The Organiser bears no liability whatsoever to any Participant or other person that takes part in the Rewards in violation of the applicable law, contractual obligations or provisions of these Terms and Conditions.  The Organiser will also take all necessary steps to comply with the mandatory requirements imposed upon the Organiser of the Rewards by the applicable provisions of all applicable Rwandan laws.
Any claim of a Participant will be resolved by the Organiser, if it is well-founded, assuring the equality of chances for the Participants and repairing the prejudice, if possible.

9. Disclosure and Publicity

The Organiser shall be responsible for publicising the Rewards and the publicity may be through a range of publicity formats and in all media.

10. Acceptance of the Terms and Conditions

Participation in this Rewards shall mean full acceptance, on the part of the Participants, of the present Terms and Conditions.

The present Terms and Conditions shall be available free of charge at the website http://www.mtn.co.rw.

11. Protection of Personal Data

By participating in the Rewards, the Participants expressly agree that personal data which they supply shall be processed by the Organiser for the purposes of executing the Rewards and also for the purpose of publicising the Rewards and the Organiser.  It is hereby specified that the Organiser guarantees that publicity, entailing the sharing with third parties of personal data supplied as a result of participation in the Rewards, (including through television, the press, leaflets and other means and formats of communication) shall be made only with respect to the winners of the Prizes and will only indicate the given names and surnames of the winners, their images and voices (contained in photographic records, audio, video and other types of records, made with the purposes of publicity connected to the Rewards).  The winning Participants give, through their participation in the Rewards, express consent for the use of this data in formats herein defined.  Following the termination of the Rewards, the personal data will be destroyed.

In accordance with local laws and regulations, the Organiser respect the privacy of Participants of this Rewards, by which it is committed to the use of technology in a transparent form and in strict observance of the rights, freedom and guarantees of the citizens and by the reservation of the intimacy of their private and family life.  The personal data collected within the scope of this Rewards will be treated as private and confidential.  It shall not be disclosed to other individuals or organisations, except in the event of legislation to the contrary or where such is authorised by the Participants themselves. The data will be stored on servers with access controlled on a need-to-know basis and limited by passwords.

12. Amendments to the Terms and Conditions

The Organiser reserves the right to alter, suspend or cancel this Rewards and respective Terms and Conditions, without prior notice and, where required, upon prior authorisation issued by the appropriate authorities. The new rules shall come into force upon disclosure by publication on the website http://www.mtn.co.rw
No claim in respect of any alteration of the present Terms and Conditions is enforceable against the Organiser following the moment at which this alteration becomes available for online consultation on the website http://www.mtn.co.rw

In the event that the Rewards is suspended prior to the period designated for its conclusion, namely prior to the 30th August 2019 the Organiser shall award the Prizes corresponding to the winners selected up to the date of the suspension of the Rewards, in accordance with the present Terms and Conditions. 

13. Final Provisions

In no event shall the Organiser be held liable for external fluctuations that might affect the economic value of the allocated prizes.

The present Terms and Conditions shall come into force on the 31st of May 2019 and remain valid until 30th of August 2019 or until amended or suspended by the Organiser.  They may be freely consulted on the website (http:// www.mtn.co.rw) during the Duration Period of the Rewards.  Participants may request additional information in respect of matters connected to the Rewards, as well as suggestions or possible complaints, by calling 100 from a mobile telephone that is subscribed to MTN’s mobile network 24 hours a day, 7 days a week, during the Duration Period of the Rewards.
Any dispute arising from or connected to this Rewards shall be subject to the exclusive jurisdiction of the Rwandan competent authorities and in accordance with Rwandan law.

Q: How do customers know they have won a prize?

A: Those who are awarded with Cows, 1 million Cash, LG TV SET, Laptops, Smartphones, YOLO Hoodies and Ikosora feature phones will receive a call from an MTN Call Center Agent. ONLY THIS NUMBER WILL BE CALLING WINNERS - 078 400 0000.

For others, an SMS notification will be sent to them with the header YOLOIZIHIRWE.

Q: How does a customer get receive a gift?

A: To receive a gift, you need to use more of MTN YOLO products (voice and Internet). Subscribers will receive notifications when they reach 50% and 90% of their monthly targets.

Q: How long will the Campaign run?

A: The Campaign will run for 12 weeks.

Q: Do I need to dial a number to activate the Minutes of calls, SMS’s and MB’s for data use?

A: No, you do not need to dial any number. These will be automatically loaded onto your phone after MTN sends an SMS notification.

Q: How does a customer claim their gift?

A: Winners that have been called on 078 400 0000 will be given instructions of where and when to collect their respective gifts. And those that have received SMS notifications will be requested to collect their gifts at the nearest service centers.

Q: Can a customer claim the gift after the promo has ended?

A: No, Gifts not redeemed within thirty (30) days are deemed forfeited (refer to the Terms & Conditions)

Q: If the call center agent calls the customer and the phone is off, does it mean they lost that gift?

A: Yes. At least three attempts will be made to communicate by telephone from the designated MTN line (078 400 0000). In the event that it is not possible to establish a telephone communication with the winner and when the aforementioned attempts for such purpose have been made, the Winner will be replaced with someone else.

Q: How many times does the call center agent call the winner?

A: At least three (3) times. First attempt is to inform the winner and the Second and third attempts are to remind the winner to collect their respective gift.

Q: How many times do we send SMS notification to the winner?

A: Twice (2). First attempt is to inform the winner and the Second attempt is to remind the winner to collect their respective gift.

Q: After receiving the gift, is it a property of the winner or MTN’s?

A: Yes it is.

Q: Does a customer have to travel to Kigali to get their gift?

A: Depending on the instructions that were given by the MTN representative as well as the SMS notification, the winner will be instructed on where and when to collect their gift.

Q: How does the winner of the cow get it?

A: The winner will be called on the designated MTN line (078 400 0000) and given instructions of where and when to collect their cow. ALL winners irrespective of the pickup venue are required to come with or organize means of transporting their cow(s).

A: Yes, you can buy more than one YOLO pack or bundle since the talk time minutes and data are cumulative.

Q: How do I check my YOLO voice & data bundle balance?

A: Dial *154# choose option 5 for balance check or alternatively dial our direct shortcut *154*5# to directly know your balance.

Q: Who is eligible to access YOLO?

A: YOLO is a product designed for the youth between 16 – 25yrs. Those above 25 years are transitioned to YOLO Senior (above 25yrs offers).

Q: Apart from voice and data what other advantages are in YOLO?

A: A customer who activates any voice pack or data bundle gets to enjoy night offers of 1 free GB & 1hr free night calls from midnight to 6am in the morning.

A: A customer who activates voice pack or data bundle enjoys the variety and options to pick from a Mash-Up of offers: voice packs, data bundles, voice+data and data+social media bundles.

A: A customer gets to enjoy the benefits of Yolo Star Loyalty Program that offers a variety of lifestyle benefits.

Q: When is the bonus effective?

A: All bonuses (data and voice) are effective after mid night and from that time they take priority till exhausted.

Q: When can I see/ get the bonus details once a YOLO pack or bundle is activated?

A: All bonus details can be seen by checking the balance on *154*5# anytime.

Q: How many bonuses do I get when I activate a YOLO pack or bundle twice in a day?

A: You still get the bonus due to one activation, it’s a one-off offer. This applies to weekly and monthly activations too.

Q: When does the YOLO Extra voice pack work?

A: It is a daily voice pack that works the whole day expect between 6 pm – 10 pm.

Q: How does one access/get social media bundles (WhatsApp and Facebook)?
